ISLAMABAD: The Supreme Court Wednesday directed the chief secretaries of all the provinces and chief commissioner Islamabad to submit detailed reports before it by November 14 regarding right of inheritance of eunuchs.

A three-member bench comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Khilji Arif Hussain and Justice Tariq Parvez observed that eunuchs are part of our society, who cannot be deprived of their right to inheritance.

During the hearing, a senior official of National Database and Registration Authority (Nadra) told the court that two posts have been allocated for eunuchs in Nadra. A senior official of Social Welfare Department Punjab apprised the court that District Coordination Officers (DCOs) of the provinces are taking concrete steps for transfer of inherited land to the eunuchs. He said an eunuch of Sialkot has been given 26 kanals of land from the land of his father.

President of the she-male Association of Pakistan, Almas Boby, told the court that the government is getting tax from eunuchs in Karachi despite the fact that they are given lesser wages. A representative of Sindh Government told the court that eunuchs have been involved in anti-polio and anti-hepatic campaign. The chief justice observed that eunuchs are part of our society, thus they cannot be deprived of the right of inheritance as well as other rights, enjoyed by other citizens.

He asked all the provinces to play their due role to ensure right of inheritance to eunuchs. The court adjourned further hearing till November 14. On last hearing, the court had directed Nadra not to indulge in ‘gender’ verification of eunuchs by a medical board and amend its laws to declare transgender as she-male. The court had asked all the provincial governments to protect fundamental rights of eunuchs and also take steps for giving them inheritance right
