US patient sues doctors over botched circumcision

Something was absent without leave when Johnny Lee Banks came out of the anaesthetic after what should have been a routine circumcision at a hospital in Birmingham, Alabama, last month. That, at least, is the claim in a medical malpractice suit filed this week that has men across the state, if not America, clenching their midriffs in horror.

"When the plaintiff ... woke from his aforesaid surgical procedure, his penis was amputated," the lawsuit states. It goes on to contend that no one at the Princeton Baptist Medical Centre in Birmingham has been able to explain why it had become necessary to remove the entire organ rather than just the foreskin as he had expected.

"My client is devastated," said John Graves, a lawyer for Mr Banks. The lawsuit names two doctors as defendants in the suit as well as the facility attached to the hospital that was responsible for the procedure. It was filed jointly by Mr Banks, who is 56, and his wife, who is claiming the marvellously legalistic "loss of consortium".

A spokeswoman for the Baptist Health System, which owns the hospital, said the lawsuit was without merit. "We intend to defend all counts aggressively," said Kate De Witt Darden. Meanwhile a lawyer for the two doctors named in the suit was similarly dismissive of the claims. "The allegations in the complaint are completely untrue" said Mike Florie. "The claims are totally without merit and we intend to defend the physicians vigorously in the case".

Attempts to speak to Mr Florie were unsuccessful and it was not clear which part of Mr Banks' complaint he considered untrue - that he had not been consulted prior to the amputation or that his penis had been removed.

The lawsuit does specify what order of financial compensation Mr Banks is expecting. In a similar case in 2011, a retired lorry driver in Kentucky sought $16m (£9.6m) in damages when a doctor amputated part of his penis during a circumcision procedure after finding it was afflicted with cancer. The man asserted that the doctor should have halted the procedure and asked permission before taking the additional step. The jury, however, found for the doctor.

I guess until we see a picture of Mr Banks we can only wonder. If he is half inch shorter after circumcision that would be about right or does he have a half inch stump?

(visions running through my head and a smile on my face)

What some of us dream about he gets and is upset, go figure.

I know nurses who work in orthopedic surgery who routinely write on the Other Limb "WRONG LIMB" when an amputation is required.

I've dealt with quite a few doctors and if If I had to have a limb removed, I would definitely write on the opposite limb wrong one.

Doctors make mistakes. Operating room staff makes mistakes.

I woke in the middle of a surgery once - not half awake but ALL awake - and that was the anesthesiologist's mistake.

So you think I trust doctors to be right all the time?

No.

I some how find it very hard to believe that a doctor would make that kind of mistake, like I say I want to see the pictures.

Was it really just a circumcision and the guy looks down at little willy and think part of it is missing or did the doctor really cut off his dick?

Like I say I want to see the pictures and until then the Jury is out as they say...

My testicles were removed separately, when I went in the second time I had a large arrow drawn on my right leg pointing to the remaining testicle, I said to the surgeon who I hadn't seen before why he was doing it when he came in for his pre-op talk, as it wasn't like there was another one he could remove by mistake, he replied " no, but there is other things in the vicinity." He never referred to what exactly and I didn't ask, it didn't exactly reassure me of his capabilities, as it turned out I got an infection after so I might have been justified in being nervous.

We deal with a school of nursing here for pictures on a regular basis. I am sure A-1 will know which one I am talking about.

These kids are graduating from NURSING SCHOOL, for God's sake, and they can't show up when they're told to, they can't fill out an order form clearly and completely, and they often ask things like "How big is an 8x10?" when they've been looking at 8.5x11 paper since kindergarten. Frankly, if I were in the hospital and the doctor or nurse was under 45, I think I'd make a miraculous recovery and run away. It scares the hell out of me, knowing that these dingbats are going to be nurses somewhere.

So yes, I guess this incident does sort of go without saying, on second thought.
