You could get Money from a Settlement

A judge in the District of New Jersey has recently approved a Settlement of two class action lawsuits concerning Dreamfields Pasta. The lawsuits allege that advertisements and packaging claiming Dreamfields Pasta has a 65% lower glycemic index than traditional pasta or that it has only 5 grams of digestible carbohydrates per serving are false and misleading. Dakota Growers, the maker of Dreamfields Pasta, denies these claims.

Records show that you signed up to receive recipes and coupons for Dreamfields Pasta and that you may be eligible for a payment from the Settlement. To get relief from this Settlement you must file a claim. Who’s included? Generally, the Settlement includes anyone who purchased Dreamfields Pasta with a label that referred to “glycemic index” or “digestible carbs,” in the United States between February 2004 and July 1, 2014.

What does the Settlement provide?

The $5,000,000 cash Settlement will cover:

Purchases Made in the Store: If you purchased Dreamfields Pasta in a store and file a valid claim form you will receive $1.99 for each box purchased (up to 15 boxes per household).

Online Purchases: If you also purchased Dreamfields Pasta online you will receive an automatic payment of $1.99 per box. There is no limit on the number of boxes.

Depending on the number of valid claims received, your payments may be increased by as much as 50%, or decreased to allow all Class Members to share the Settlement proceeds equitably.

Other Costs: Payment of notice and administration costs.

Any money remaining in the Settlement after payment of claims and costs will be donated to the American Diabetes Association.

Changes to Packaging: Dakota Growers has also agreed to remove statements referring to “glycemic index” or “digestible carbs” from the packaging of Dreamfields Pasta for one year.

How can I get a payment? For purchases of Dreamfields Pasta made in a store (as opposed to online), you must file a claim form. What are my rights? Even if you do nothing you will be bound by the Court’s decisions. If you want to keep your right to sue Dakota Growers yourself, you must exclude yourself from the Class by September 1, 2014. The Court will hold a hearing on September 24, 2014 to consider whether to approve the Settlement, and a request for attorneys’ fees and expenses up to $2,920,000, which would include an incentive award for the five plaintiffs named in the lawsuits in an amount not to exceed $20,000 in total. The attorneys’ fees, expenses, and incentive award will be paid separately by Dakota Growers and will not reduce payments to Class Members. You or your own lawyer may appear at the hearing at your own expense.

These class-action, low-payout-per-claimant settlements are pretty easy to horn in on.

With something like this particular CAS, if you simply prove the product is/was available at your local store and at least one old receipt with the product displayed, you could get away with saying you bought quite a few.

Note, this wouldn't work with other small-payout CASs; one-time purchases (say, a 50 dollar bar-fridge) would require a receipt or, sometimes, just having the booklet of instructions that came with the product is acceptable proof of purchase.

But with a food item that you can show is available in your market, you can claim a reasonable amount of the product, for a frozen dinner item you could claim 2 a month for a few years... it just takes one receipt and a good explanation attached.

Got a friend who gets feeds on these sorts of payouts and makes a nice little side-job worth of income jumping in... 🙏

I got this via email from the company. As I printed out their coupons, I figure they'll believe me. Maybe not. Worth a shot.
