Mbarara woman who cut off defiler’s genitals acquitted

COURT in Mbarara on Monday dismissed a case of a woman who chopped off the penis of her neighbour.

Angelina Kyomugisha, 37, accused Geoffrey Mugarura of allegedly defiling her 10-year-old daughter in June last year. She had been accused of causing bodily harm to Mugarura.

Court, presided over by the Grade One magistrate Matthew Tumwijukye, said prosecution had failed to produce the complainant and other witnesses. If convicted, Kyomugisha would have been liable to imprisonment for five-years.

After acquittal, an excited Kyomugisha smiled and waved to the people in the courtroom.

Asked to comment about the matter, she broke down and cried as she said: “I could not expect this; God is great to see that I am also going to settle with my children without court stress. I was about to fail to report to court every month as I was required because transport fares had increased.”

Kyomugisha is a resident of Rugyerera village in Rwanyamahembe sub-county Kashari county.

She said she was weeding her banana plantation and she heard her daughter shouting for help. She rushed to the house and found Mugarura on top of her child.

This, she said, prompted her to chop Mugarura’s genitals and throw it in nearby bush. The crowd searched for the penis for hours in vain.

Later, a dog was seen trying to run away with the organ. Residents chased the dog, recovered the penis and handed it over to the Police. It was later taken to Mbarara Central Police Station as an exhibit. A bleeding Mugarura was rushed to Mbarara Hospital.

He did not regain his manhood because doctors failed to re-attach it. The stump was refashioned so that he can pass urine.

When Kyomugisha was arrested, women lawyers from FIDA stood her surety and she was bailed out of prison. The lawyers also met Mugarura’s medical bills and reconciled both parties.

Justice! Good for her! Raping a ten year old girl, he deserved more than what he got, or lost. I think this should be the punishment for all rapists. The article wasn't very specific, what did he lose? Just his penis? Was that all?:)

Hey, it's worse that way. If he still has his testicles, he still has his libido but has no way to satisfy it. This is a lifelong punishment which will torture him every day he lives.

This is truly a bit of good news! I seriously think that this woman should not only have been acquitted, but also in some way REWARDED for he action. She truly has done a service to her community and deserves to be recognized for her bravery.

I felt so sad when I read that she almost had to miss a court appearance because she could barely afford bus fare. Seriously, if I had this woman's address I would send her a few dollars and tell her that she is a fine example for what she has done. She deserved to be decorated or at least monetarily compensated.

He really needs to be in prison.

Dis-membered or not he will still be a threat to others, maybe more so now that he can't obtain self-sexual gratification.

Or, in the alternative, de-ball him so that he is a nullo and impose lifelong anti-testosterone therapy to ensure that he has no sexuality at all.

In this way he would be punished adequately. Also Protecting the innocent through his de-sexualization needs to be a priority. In this way society doesn't have to pay for yet one more person in a prison. The cost of prisons is way too high, on many levels of discussion.

Rape is one of the most common falsely accused crimes. Here in the US there are hundreds of rapists who have been released from prison after DNA proved they were not the rapist. Most convicted on "eye witness" testimony. With your punishment, how do you correct it when the rapists are proved to be not guilty?

Please, let's not go back to being barbarians. It's bad enough we wrongly convict people on eye witness testimony that is proven to be the worst and most inaccurate form of evidence accepted in court.

Not only is it accepted in court but defense attorneys are not allowed to present the scientific evidence that proves how unreliable it is in court.

I don't think what happened to this fellow is barbaric in the least. He was caught in the act, no need for DNA, no need for a trial. He should lose his balls in a timely fashion.
