Dear Henri,

I wish you the best of luck in your upcoming trial. Hopefully, it will turn out well. Remember to stress that no children were harmed by writing such things. No children had their pictures taken and no children had anything to do with any of it. The material was published on an adult site where there were multiple warnings to keep children from viewing it. Also, if parents were to install a program to control content then it would be impossible for children to view such material. What you did was in the privacy of your own home on your private personal computer while in the company of no minors. Be sure to stress how you have never nor would ever do anything towards kids. I assume that you have no past record so use that to your advantage.

In the past I have only heard of legal action being taken when someone takes photographs of children or actually does something to them or exposes themselves in front of children. I hope that the judge will look at this in the light in which it should be seen. Let us know how things unfold. Best of luck to you.

Unfortunately, that doesn't seem to stop them if they want to come after you. A guy in Florida was charged with obscenity for a website he had in some island country which is outside of US jurisdiction. Technically, Germany could prosecute one of us for what we've posted, if it's made available over the Internet in that country, just as some countries have brought suit against certain US Internet companies. None of the people arrested did anything thing against the laws of their countries, but when they traveled through the USA, they were arrested for violating US laws.

I could just see myself on a stop over in Germany: "Oh, Slammr. You're under arrest for child pornography for the stuff you've posted on EA." If that's what the charges against Herni are for, I'm staying the hell away from Germany. Hell, in some country or another, there might be an arrest warrant out for all of us that have posted to EA.

I am beginning to wonder. What exactly did you submit? People are assuring you that you did not hurt (or even involve) any minors in the creation of what you submitted, but what you have said above sounds contrary to that.

It sounds like you are saying that you used real minors to create your submission, perhaps by observing and transcribing or perhaps actual minors participated in the creation of the story in some other way.

Defend yourself, please. Tell us that you did not actually hurt anyone.

My reasearch (internet) shows that Germany claims jurisdiction over violation of their laws commited anywhere, not just on German soil. This may have come about as a way to prosecute war criminals and human rights violators but, in fact, has been extended to most major issues. Writing about, reading or possessing material involving children (defined as those under 18 years) in sexual situations is a serious crime by German law. There are exceptions made only for certain research, medical or artistic purposes as defined by the government. There are similar jurisdictional claims in Spanish law. --FLO--

Pretty well all countries seem to take this approach. Our country is going after the people involved in Internet gambling companies, even though they're doing nothing against the law in their countries. The USA can't arrest them in their own countries, but several have been arrested during stopovers in the USA. Even the head of Net-teller was arrested because they provided funding for the gambling sites. They're even going after some of the banks that backed the shares of the Internet gambling companies. Germany could arrest many of the authors of stories posted to the EA, if those stories violate their laws, which they seem to do. And many of the stories may violate the laws of countries like the UK and Australia, too.

Oh, well, I have no trips to Germany planned.

I'm going to go out on a limb and say that he has never, in any way, brought harm to any actual, physical child.

The way the laws work in some countries, 'adult' stories involving minors, and 'adult' drawings (not pictures, drawn images) involving minors are considered child pornography as much as any photograph or video. What's worse, in some cases you may be winding up with more charges and a longer sentence than if you'd actually molested a kid.

There was a recent case of a teacher in British Columbia arrested and charged with possession of child pornography. It was mentioned that there was one mitigating fact when it came to sentencing: said materials contained no photos or movies. I can only draw one conclusion, that the teacher had stories and drawings which depicted children.

Look at the UK even, where they are (last I heard) trying to pass a law banning violent pornography, even if such violence is drawn or written.

I still think some high caliber lawyer somewhere needs to file a huge suit banning all religious texts on this very basis.

I'm really concerned about this trial in Germany. I've never ben writing about catration. Neither was I writing child porn. Nevertheless, throughout all of my stories the main character, a minor, gets his testicles abused several times a day, along with some other minor characters. And after all this - I'm totally against any sort of child abusement. My stories are published here, on a site that warns everyone at the entrance about the thing one may found inside. My stories are totally personal and mostly based on the fantasies I had a s a minor. And this site is the best place for many guys to "pour out" the fantasies, fairs and feelings of their early years.

Most of Freud's ideas still stay reliable in this world. My experience is not an exeption. I mean the theory of the geniatal stage of the psychosexual development of child, which is between 3 and 6 years old, when everything that happens to a child, and specially something concerning his or someone else's genitalia, may result in fixation, which could give rise to a sexual fetish.

Just by the end of this "genital stage" I got my testicles abused in the presence of many naked girls and women, which resuled in such strong fixation in my mind and was the reason of all my following fantasies. The fantasies that I only got able to pour out after the internet came into my life...
