If it weren't for freedom of speech in our country, every story in the Archive about children would illegal, subjecting the Archive and the authors of them to penalties.
I followed this thread with great interest - the reason is an experience during my childhood (10/11 years). This experience was followed by my first castration fantasies. May be that I'll tell it later.
Now I'm not active on EA for some months, as my former activity on EA caused important problems to me: I posted what all posted here, but what I didn't know: In Germany there is not this freedom of speech, and I have to fear to be punished for having posted stories with minors - 10,000$ or 8 months into prison. EA is in the US, but the criminal act was committed in Germany. We are expecting the judgement in february or march...

This is further evidence of how fortunate we are in the USA to have our Bill of Rights and to have organizations like the ACLU that fight for those rights. Otherwise, most of us that have written such stories would be liable to similar -- or worse -- punishments. It would even be illegal to read such stories.
How would you like to be branded as a sex offender for what you thought or for what you read?

While -- before puberty -- kids may be curious about their private parts and about those of other kids, I don't think there's any real drive for them to engage in sex with other children. A boy is probably going to be satisfied with rubbing his own little penis. Unless the kid has been exposed to sex, either though being abused himself or through his observation of others, I don't think sex is going to be important to him.
I'm not particularly comfortable writing about prepubescent kids having sex. I've written stories about societies in which they were castrated, but as a reflection of history. Untold thousands of kids were castrated throughout history before they reached puberty, and in many cases, they were castrated to make them better sex partners for adults. Often I'm presenting what did occur in the past in either a modern or futuristic perspective.
As Kangan implied, stories are stories and fantasies are fantasies. I can imagine what it would be like to kill someone; I might even write about it; but that doesn't mean that I'm going to go out and do it. Strange isn't it, that it's not illegal many places to write a story about killing kids, but it is illegal to write about cutting off their balls or about their having sex.

Remember, It is not a thought that makes you legally insane or a criminal in our society, it is an action or behavior.

This is ridiculous.
In fact, if one were to push the issue, then all copies of the Holy Bible must be banned in Germany and everyone with a copy must be prosecuted as well. Especially those with the illustrated editions, which contain reproductions of some of the greatest artwork ever produced.
One image in my family Bible is that of the Angel of Death stabbing a little boy through the heart -he's naked, as are most of the dead boys all around him.
And let's not forget all of the violence done to children in the Bible. Open it to almost any page - you'll end up in the middle of story where at least one child - usually a boy - has something terrible happen to him.
While we're at it, then Germany must issue arrest warrants for Stephen King, Anne Rice, Dean Koontz, David Eddings, Orson S. Card, and the list goes on and on. I'm sure there are copies of their books sold in Germany at some point in time.
PS - actually, EA (the server box) is NOT located in the USA.

Dear Henri M. Tell us more about the Case.
Who is the Judge, the Prosecutor , names and place - please - facts are allways important. So publish all the facts and maybe the world as we know it will understand more. Law is usually a sort of Microscope to view what the world doesn't understand too well and when the society is totally ignorant, they use this microscope more often. The Writers and the Thinkers should be protected from the wild use of this TOOL, the microscope of the LAW as it is designed to do. Punishment should not be an absolute, because the society doesn't understand the creative's in it. N3RF

You have my sympathy for your unfortunate mistake.

I'd recommend hiring a very good (expensive) lawyer, and having him make a plea deal with the prosecutor that will allow you to keep your freedom. Juries tend to be very unforgiving of mistakes - forget about a trial.
So how do you define pornography? Unfortunately, the definition changes depending upon the legal jurisdiction and the mood of the prosecutor or judge.
One of my favorite cartoons depicts a man and a woman in an art museum in a room full of nude statues and paintings. The woman asks, "How can you tell the difference between art and pornography?" The man replies, "It's pornography if you giggle."
