Pehaps he could sink some of that money in Bio-Research (Stem Cells or whatever) and grow himself a new penis someday...

On a more serious note, I have to agree with Kristoff. $3.5M is on the low end. This would be a very serious loss for a guy who didn't want to lose it!

Substantial awards have been made for "pain and SUFFERING " [capitals mine]

It is hard to place a price on the suffering endured by a man who has had to endure involuntary penectomy, but I would agree with Kristoff that $3.5M is on the low end of compensation for that. Then, also, the damages are doubtless partly, perhaps even in large part, punitive and I would have to say that such large punitive damages are fully justified by such egregious incompetence.

If the guy was a sex worker you could calculate loss of earnings.

But how do you quantify "suffering" and reach a pay-out sum?

The suit is asking $3.5M, which suggests perhaps his lawyers think that winnable (or collectable, which might be more to the point). That's a tidy sum, enough to pay off the mortgage, put the kids through college etc etc.

The $10M Kristof suggests is a little different, that would be enough to live off the interest alone for the rest of his life if he isn't too extravagant. Now I can't quite say why, but that seems a bit much to me.

Of course this assumes the suit succeeds. There's always the possibility that no negligence or other liability is shown.

Just remember, lawyers USUALLY get 30 per cent of the award at the very least. So, his 3.5 million would be cut down. Oh, he could still do some great things with the 1 million+ that he would get, even live high o the hog fro a while.

I would like to try to live on 1 million for a while.

Of course, I am suspicious as to why a cut finger led to a hernia examination? Or did he have his hand/finger stuck somewhere close by? Or did the doctor have his hands somewhere besides the suturing tray?

Sounds like one of those evil doctors in the stories on EA who leads the patients on when they come in for something as simple as a cut on the finger and ultimately result in them having to undergo penectomy. :P

Not FAIR!

He has already been "cut down" once.

...I would agree, malpractice to that degree is CRAZY...

...he would have been better off to go to BME and found somebody to cut his finger off instead...

3.5 million, hmmm... I wonder if they could do a penis transplant...

...after all, they seem to transplant everything else...

...the story reminds me of a bad joke I heard one time...
