Jury deadlocked in Harnett County castration case

LILLINGTON — The jury in the case of a Harnett County woman accused of malicious castration reached a deadlock Friday, but the judge ordered them to return Monday for more deliberations.

A little after 7 p.m., the jury foreman told the judge that the panel was split 11 to 1. The foreman did not reveal whether the split favored guilt or innocence.

Defendant Rebecca Dawson, accused of using her fingernails to tear off a man’s scrotum at a Christmas party last year, cried when the jury made the announcement.

On another charge of assault inflicting serious injury, the foreman told the judge that the jury was split 8 to 4. Which group favored guilt wasn’t revealed.

Deliberations started around noon. Just before 7 p.m., the jury sent a note to the judge that said, “We are deadlocked. We cannot all agree to make the same decision.” Judge Steve Balog called the jury into the courtroom.

One female juror was crying and appeared angry when she took her seat. Another juror — one of four men on the panel — shook his head and asked permission to address the judge.

He said, “When they say we’re deadlocked, we’re deadlocked. Ain’t nobody going to budge.”

The judge told the jurors they must reach a decision and ordered them to continue deliberations at 10 a.m. Monday.

In closing arguments earlier in the day, the defense said Dawson tore Kevin Russ’ scrotum in self defense. But the prosecutor said Russ was the victim, and described the injury as a vicious attack from an angry, drunken woman.

Russ, Dawson and others had been drinking heavily at a Christmas party in Lillington. According to testimony, Russ and Dawson got into a fight during which she ripped his scrotum with her artificial fingernails.

Jason Wunsch, one of two lawyers representing Dawson, repeatedly called Russ’ version of what happened “preposterous” in his closing argument.

Wunsch raised questions about Russ’ assertion that he was the victim of an unprovoked assault. Russ, Wunsch reminded the jury, is a former Special Forces soldier.

“This person knows how to control a situation,” Jason Wunsch, defense attorney.

Wunsch said that the report from an officer on the scene did not corroborate Russ’ story, and the lawyer reminded the jury that no medical evidence of Russ’ injuries was submitted.

According to Wunsch, Dawson grabbed Russ only because he was holding her and would not let her go.

“She’s no saint,” Wunsch said of his client, who testified Thursday that she had been drinking heavily and had taken off her shirt after Russ asked her to have sex with him and his girlfriend.

But, Wunsch said, “She certainly didn’t ask for this to happen.”

During her trial, a police officer testified that she cracked a window on a patrol car by kicking it and shouted profanity at officers and a magistrate.

Wunsch said that she was angry because she was being arrested when she was the real victim. He said that officers basically stopped the investigation when they saw the injury to Russ.

Assistant District Attorney Charles Bullard said that Russ underestimated how dangerous Dawson could be. Russ testified Wednesday that he was simply trying to keep her from driving home because she had been drinking heavily.

“Rebecca Dawson is very violent when she is drinking and doesn’t get her way,” Bullard told the jury. He said that she doesn’t fight like a woman.

“When you lay hands on her, you better be ready to fight a man,” he said.

Russ testified that Dawson clawed his face, then grabbed his scrotum. Bullard said that she escalated the fight because he wasn’t fighting back.

“She meant to harm that man in the most private way, in the most permanent way,” Bullard said. “Kevin Russ will never be the same man.”

Bullard showed the jury pictures of what he described as a “hunk of meat” torn from Russ’ scrotum. That was all the medical evidence needed, he said.

LILLINGTON — Testimony continued today in the trial of Rebecca Arnold Dawson, the Lillington woman accused of castrating a man during a Dec. 26 Christmas party last year.

Kevin Russ, the man she is accused of maiming, testified that Dawson clawed at his scrotum, removing large chunks of skin and tissue.

Russ testified Tuesday and Wednesday.

Twelve jurors and one alternate — nine women and four men — were seated to hear the case.

Dawson was offered a plea by prosecutors, but she declined and decided to go to trial.

Police said Dawson used her hands on his genitals. Doctors had to remove half of one of Russ’ testicles and all of the other, police have said.

Dawson is charged with malicious castration, assault inflicting serious bodily injury, malicious conduct by a prisoner and injury to personal property. In addition to maiming the victim, police have said, Dawson fought with the officers who arrested her.

Malicious castration is defined as cutting off, maiming or disfiguring a person’s genitals with the intent to hurt the victim or render him impotent.

Dawson and the man had been drinking with other people at the home of the man’s girlfriend, on Summerville-Mamers Road in Lillington, police said.

Dawson has contended she had to defend herself against the man after he pinned her against a wall and that she had no intention of causing a severe injury.

It is very simple. Just remove half of the offended /offending unit. Happens all the time. At one time, and sometimes still, doctors would partially remove a testicle in an effort at preservation of function and appearance, such as testicular cancer patients whose cancer is a tumor - isolate tumor and remove only that segment. Most doctors, however, remove the entire testicle as preventative as well as curative action.
