This is what happened in the sodomy case in Houston where the Supreme Court found for the defendants. I'ne heard several time the case was a "put up" and the DA was bigoted and stupid enough to bite. A gay activist had an editorial in the Houston Chronicle thanking the DA for taking the case to the Supreme Court and getting the sodomy law thrown out.
