Judge's unusual order to man with nine kids: Stop procreating

Racine County Sheriff's Department

Corey Curtis, 44, was sentenced to three years of probation on Monday with the condition that he is not to procreate until he

can support the nine children he fathered with six women.

By Andrew Mach, NBC News

A Wisconsin judge has ordered a man who owes $90,000 in child support after fathering nine children with six women to not have any more kids, at least for now.

Racine County Circuit Court Judge Tim Boyle sentenced Corey Curtis, 44, to three years of probation on Monday with the condition he is not to procreate until he shows he can support his children, according to court documents.

Curtis pleaded no contest in October to one count each of felony bail jumping and failure to pay child support.

Assistant District Attorney Rebecca Sommers said Curtis owes about $50,000 in back child support, plus another $40,000 in interest to the mothers, the Journal Times reported.

“Common sense dictates you shouldn’t have kids you can’t afford,” Racine County Circuit Court Judge Time Boyle said at a hearing, according to the Journal Times. “It’s too bad the court doesn’t have the authority to sterilize.”

In his decision, the judge cited a 2001 case in which Wisconsin Supreme Court justices upheld a Court of Appeals ruling that a judge may, as a condition of a person’s probation, order the defendant not to have another child unless he can show financial viability.

Curtis told local station WDJT-TV he planned to comply with the unusual order in his case.

"Judges, they make rulings," Curtis said. "They make them kind of hastily. So, if that's what he feels one of my conditions should be then I'm going to abide by it."

This isn't the first time a judge has made a ruling intended to block breeding.

A Kentucky judge in March ordered a man who had fathered a dozen children by 11 women to refrain from having “any sexual intercourse” for the one-to five-year period he’s on parole.

A Texas judge in 2008 sentenced a 20-year-old mother to 10 years probation for not protecting her 19-month-old daughter from abuse by the child's father. The judge ordered her to not get pregnant during her probation.

I have a dirty mind.... :( Or read too much EA stories.

I am thinking, how it is going to be enforced. Chastity belt, anyone?

Metal one to add the embarrassment when dealing with TSA. (Ok, that feels cruel).

Why is forced sterilization illegal?

Up until the 70s? I war performed without concent on mentally ill patients in various countries.

My perspective on reproduction has been drastically changed by both my loss of testicles and my wife's hysterectomy.

You have laws in the US about many dangerous activities, drugs, sugar now too.

Anti-obesity laws etc.

It is all about saving the health and wellfare costs. In line with those policies it would be logical that forced sterilization would be another goal of that system?

The legal maxim is that the State may not do harm to a citizen's body such as forced sterilization, forced abortion, forced hand chopping off for theft,

Even the Death Penalty is restricted to certain specified actions because there is the prohibition from "cruel and unusual" punishments.

I hope I didn't take you too seriously.

I was looking at it more historically.

Also I will say I am not an Amerincan and do not live in the US, my understanding of your current laws is vague at best.

In the 1930s force sterilization without concent was somewhat of a normal practice at mental institutions. I think the practice continued for quite some time after.

The arguement would ultimately come down the the rights of the individual versus the rights of the society as a whole.

Your American legal framework tends to put the rights of the individual over the rights of society (my view from the outside)

I an not trying to piss anyone off here, I really just do not understand the current culture.

The problem is - it is irreversible.

Judges make mistakes, court decision can be overruled. Someone can be framed. Etc.

The problem I see with the laws you mention, is the trade off between state control vs personal responsibility.

They assume irresponsible individual. And I do not like it. But that line of discussion probably has place in political forum, which we lack now.

Thanks

The culture I live in is so different and has rewired my thinking.

Seems I have lost the idea of the individual over the group.

I agree!

In truth, considering that the taxpayers are supporting his kids because he chose not to , it is a shame that we really can't castrate him.

THIS is bullshit.

HE doesn't need castrated. He needs thrown in jail for the back child support. He can have all of the sex there that he wants, it just won't be with women.

Now, another silly question. How can this man with 9 children by 6 different women ONLY OWE 50k with 40k interest in back child support? What did he do when he DID work? Not much, I suppose.

No matter, throw his ASS in JAIL for back support. Put him in a small city cleaning sewers and forbid him to leave it. Have the police harass the hell out of him.

I mean, do these Judges think that they will stop procreation by a court order? Hell, the Pope cannot even do that and he had GOD on HIS side...
